Foundations of Law 70102: Cases

In this guide:

PRIMARY LEGAL RESOURCES: CASES

CASE CITATIONS

Case citations include the publication year. In case reports found in law report series, the publication year can be in either round or square brackets.

Round brackets indicate that the law report series is arranged on the shelf by volume number. Square brackets indicate that the law report series is arranged on the shelf by year. Square bracket citations may not necessarily have a volume number.

Green v The Queen (1949) 79 CLR 353

R v Petronius-Kuff [1985] 3 NSWLR 178

CASE CITATION COMPONENTS

Case Name: Green v The Queen  R v Petronius-Kuff
 Publication Year:  (1949)  [1985]
 Volume Number:   79  3
Law Report Series Abbreviation:  CLR  NSWLR
 Starting Page:  353  178

The exception to this is a medium neutral citation: this does not refer to a law report series. This is the court's own citation to the online version of the case: the judgment year is in square brackets. Medium neutral citations in this format are avaialble from 1990. Judgments are arranged by judgment number, not by page. Pinpoints must refer to paragraph numbers (because there are no page numbers), and be in square brackets.

Martin v Kelly [2009] NSWCA 105

Case Name: Martin v Kelly
Judgment Year: [2009]
Court Abbreviation: NSWCA
Judgment Number: 105

Note that in this instance the court is the New South Wales Court of Appeal. With a pinpoint to paragraph 3 this would be: Martin v Kelly [2009] NSWCA 105, [3].
